TERMS & CONDITIONS
1. Scope
(1) These General Terms and Conditions (GTC) apply to all contracts concluded between ALESSA, Atelier Jana Alessa Schroth, Kopenhagener Straße 49, 10437 Berlin (hereinafter “the Seller”) and the customer (hereinafter “the Client”).
(2) Different terms of the Client shall not apply unless expressly confirmed in writing by the Seller.

2. Services
(1) The Seller offers made-to-measure tailoring, design services, creative projects, and the sale of ready-to-wear products (online and offline).
(2) The exact scope of services or product details is specified in the respective order confirmation or online product description.

3. Conclusion of Contract
(1) For custom-made services: A contract is concluded once the Seller accepts the Client’s written order or begins execution of the order.
(2) For online shop purchases: By clicking the “Order with obligation to pay” button, the Client submits a binding purchase offer. The Seller accepts the offer by sending an order confirmation via email.

4. Prices and Payment
(1) All prices are stated in Euro and include VAT, unless otherwise indicated.
(2) Payment methods available are displayed during the order process (e.g. bank transfer, PayPal, credit card).
(3) For custom-made services, unless otherwise agreed, 50% deposit is due upon confirmation, with the remainder payable upon completion.
(4) Goods remain the property of the Seller until full payment has been received (§ 449 BGB – retention of title).

5. Delivery and Shipping
(1) Delivery times are stated in the product description or order confirmation.
(2) If not otherwise specified, delivery within Germany takes place within 5–10 working days after receipt of payment. International deliveries may take longer depending on destination.
(3) Shipping costs are displayed during the order process.
(4) If delivery is delayed due to force majeure (e.g. strikes, illness, supply shortages), deadlines are extended accordingly.

6. Custom-Made Goods (Tailoring & Design Projects)
(1) The Client must provide accurate measurements and attend fittings as required.
(2) For goods made to the Client’s specifications or clearly personalized, the statutory right of withdrawal (§ 312g (2) No. 1 BGB) does not apply.
(3) Minor deviations in material, colour, or fit that are technically unavoidable do not constitute defects.

7. Right of Withdrawal (Online Purchases of Ready-to-Wear Products)
(1) Consumers (as defined in § 13 BGB) have a statutory right of withdrawal for distance contracts.
Withdrawal Policy

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day on which you or a third party designated by you, who is not the carrier, took possession of the goods.

To exercise your right of withdrawal, you must notify us (Atelier ALESSA, Jana Alessa Schroth, [address], [email]) by means of a clear written declaration (e.g. email or letter).

To meet the withdrawal deadline, it is sufficient that you send the notification before the withdrawal period has expired.
Consequences of Withdrawal

If you withdraw from this contract, we shall reimburse you all payments received, including delivery costs (except for additional costs arising from choosing a type of delivery other than the cheapest standard delivery offered), within 14 days of receiving your withdrawal notice.

Reimbursement will be made using the same payment method as in the original transaction, unless otherwise agreed.

We may withhold reimbursement until we have received the returned goods or you have provided proof that the goods have been sent back.

You must return the goods to us without undue delay, and in any event within 14 days from the day you notify us of withdrawal.

You bear the direct cost of returning the goods.
Exclusions
The right of withdrawal does not apply to:

Goods made to the Client’s specifications or clearly personalized (custom-made garments, commissioned design works).

Goods which, for hygiene reasons, are not suitable for return once unsealed.
8. Warranty
(1) Statutory warranty rights apply under §§ 434 ff. BGB.
(2) The warranty period is two years from delivery of goods.
(3) For custom-made services, warranty applies only to defects caused by faulty craftsmanship, not to fit issues resulting from incorrect measurements provided by the Client.

9. Liability
(1) The Seller is liable for intent and gross negligence, as well as for injury to life, body, or health.
(2) For slight negligence, the Seller is only liable for breach of essential contractual obligations, limited to foreseeable damages typical for the contract.

10. Intellectual Property
(1) All sketches, patterns, designs, and graphic works remain the intellectual property of the Seller.
(2) They may not be copied, reproduced, or used commercially without written consent.

11. Governing Law and Jurisdiction
(1) All contracts are governed exclusively by German law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) For Clients who are merchants or legal entities under public law, place of jurisdiction is Berlin, Germany.

12. Final Provisions
(1) Should any provision of these GTC be invalid, the remaining provisions shall remain unaffected.
(2) Amendments and supplements require written form.
